7. The Club’s Rules & Regulations

The member who wishes to join, understands, acknowledges and agrees that the Trivandrum Bikers Club (hereafter will be referred as “The Club”) is a registered club under the Travancore Cochin Literary, Scientific & Charitable Societies Act, 1955 (Reg. No TVM/TC/979/2016) & also a member of Audax India Randonneurs. Please read the following sections carefully before signing. This is a legally valid and binding obligation to release “The Club” from all known and unknown obligations and to indemnify The Club against it.

7.1

Release and Waiver of claims The member hereby remise, release and forever discharges The Club, and their office bearers, Volunteers, Agents, Successors, Heirs, Executors, Administrators, or personal representatives of and from all, and all manner of, actions, causes of action, suits, proceedings, debts, dues, contracts, judgments, damages, claims, and demands whatsoever in law or in equity, which Participant ever had, now has, or which Participant’s heirs, executors, administrators, or personal representatives hereafter can, shall, or may have for or by reason of any matter, cause or thing, whatsoever arising out of this Agreement; out of the participation of any event, use of the facilities and services provided by The Club or in any way arising out of the participation between the participant and The Club.

7.2

Indemnification The member agrees to indemnify and hold harmless The Club, and their office bearers, volunteers, subsidiaries, agents, licensors, managers and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, cost and expenses (including attorney’s fees) arising from, related to or in any way connected with, or resulting from the participation of the member in any event organised by The Club, including the possession, use, operation, or return of equipment and any other item provided by The Club, and including any such claims which allege negligent acts or omissions on the part of “The Club”.

7.3

Assumption of Risk The member agrees that riding a bicycle involves many obvious and not-so-obvious risks, which may result in injury or death to the member or others, as well as damage to property. The member also understands that riding in a bicycle involves cycling continuously for a long duration, and requires adequate stamina and physical fitness. The member agrees that such risks, dangers, and hazards are the member’s sole responsibility, and assumes and accepts all such risks associated with it.

7.4

Membership eligibility The member wishing to join The Club should be of age 18 or more. Once the membership is approved by the club, the member shall pay a joining fee and thereafter there will be fees for renewal each year. The members shall wear adequate safety equipment while riding the bicycle or participating in any cycling event. The Club reserves the right to suspend or dismiss any member without requisite safety equipment while riding a bicycle. The member shall be solely responsible for the bike and other equipment that he / she uses for the participation in the rides organised by The Club and should ensure they are of a suitable standard for participation in any rides or events. Any marker route or warning signs or directions are provided merely by way of guidance. Neither The Club nor any affiliated companies providing assistance in organizing the event under any circumstances is liable for the member choosing any route during participation, indicated by us or otherwise. The member hereby agrees that he / she shall ride in a safe manner, and shall not ride for performing an illegal activity, or under the influence of alcohol or any other illicit drugs, or without adequate safety equipment. The Club has no responsibility under any circumstances for any injury or harm that arises during the ride.

7.5

Merchandise The member can access the “TBC Merchandise” link for purchasing any of the club’s merchandise and these items are only available to purchase for members of the club.

8. Refund Policy

The joining fees or renewal fees or any item purchased from The Club’s website will not be refunded.

9. Shipping Policy

The member shall purchase the club’s merchandise from our website and member will have the option of picking the same from the club’s office or to any shipping address with in India. The member must pay the shipping charge at the time of placing the order if the member opts for shipping the item to any address within India.

10. Privacy Policy

The member wishing to join the club agree to the collection and use of personal information with this policy. We may require you to provide us with certain personally identifiable information, including but not limited to your name, phone number, and postal address. The information that we collect will be used to contact or identify you. We will not use or share your information with anyone except as described in this Privacy Policy. We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.
